Our Booking Conditions (the small print).

1. Our contract
All bookings are made with NHP Tours Limited, company number 020262V whose registered office is located at 3rd Floor, Atlantic House, 4-8 Circular Road, Douglas, Isle of Man IM1 1AG. By booking a tour with us you are deemed to have agreed to these Booking Conditions (which constitute the entire agreement between you and us) and your booking will be accepted by us on this basis. The services to be provided are those referred to in your booking confirmation invoice.

2. Validity
Dates, itineraries and prices are valid until 31 December 2026.

3. Eligibility & responsibility
By booking you confirm that you are 18+, fit to travel, and will comply with local laws and reasonable instructions from our tour leader or local guides. You are responsible for checking passport/visa/health requirements and for the behaviour of everyone in your party.

4. Deposit requirement
We generally require you to pay a deposit of 25% of our fee in order to secure your place on a tour. If you make a booking within 60 days of the departure date then we will request payment of the full amount at the time of booking. Prices are usually quoted in USD unless stated otherwise. We may accept payments in other currencies at the FX rate and fees advised at the time of payment.

5. Acceptance of booking & final payments
If we accept your booking we will issue a confirmation in the form of a deposit invoice. A contract will exist between us from the date we receive payment into our bank account, or if within seven days of departure the contract will exist when we accept your payment. Please refer to your booking confirmation invoice for details regarding final payments. Payment of the balance of the tour price is due 60 days before the departure date, for which we will invoice you separately. If this balance is not paid on or before the due date we reserve the right to cancel your booking.

6. Your details
In order for us to confirm your travel arrangements you should provide all the requested details together with the payment of the balance of the tour fee. Necessary details include full name as per passport, date of birth, nationality, passport number, passport issue and expiry dates, travel insurance details, and any pre-existing medical conditions you have which may affect your ability to complete your travel arrangements. We also require you to complete and forward a health self-assessment form. We may not be able to confirm your booking without these details.

7. Travel insurance
Like most tour operators, NHP Tours Limited does not include travel, medical or cancellation insurance as part of our tour packages. Travel insurance is compulsory for all participants in our tours and it’s the responsibility of each participant to take out a policy at the time of booking. Your insurance must be valid in all countries visited from booking through the end of travel and provide cover against personal accident, death, medical expenses and emergency repatriation, with a recommended minimum coverage of US $500,000 for each of the categories.

Some of our tours include locations at high altitudes (up to 5000 metres) and/or places that are on many governments’ “Do Not Travel” lists (eg: Kashmir). We advise that you check with your insurer that your cover is still valid in these circumstances. If not, please contact us as we may be able to put you in contact with a broker that can assist you.

We also strongly recommend that your insurance covers cancellation, curtailment, personal liability and loss of luggage and personal effects. You must provide proof of your travel insurance no more than 30 days before the date of departure or you may not be able to join the tour.

8. Dietary and access needs
Please tell us about any dietary restrictions (including food allergies) and access needs when you book. We will pass reasonable requests to our suppliers but cannot guarantee them. If you have a condition that could affect safe participation, you must tell us, and in some circumstances we may need to ask for a doctor’s letter. Failure to disclose material information may affect our ability to assist you and may void parts of your cover.

9. Cancellation by the traveller (you)
If you cancel some or all portions of your booking, cancellation fees will apply. A cancellation will only be effective when we receive written confirmation of the cancellation by email. If you cancel a tour:
• 60 days or more before departure, we will refund your deposit less an administrative fee of US$100 OR apply this amount as credit towards any future tour.
• between 30 and 59 days before departure, we will refund 50% of the total tour fee (less any charges as above) OR apply this amount as credit towards any future tour.
• less than 30 days before departure, we will retain 100% of the total tour fee (less any refunds that we can negotiate with our suppliers).

You are strongly advised to take out cancellation insurance at the time of booking which will cover any cancellation fees. If you leave a tour for any reason after it has commenced we are not obliged to make any refunds for unused services.

10. Cancellation by NHP Tours Limited (us)
Tours operate subject to minimum numbers, as indicated in section 18 below, and if the minimum numbers are not met, we may cancel the tour up to 30 days before departure. We may also cancel a tour at any time prior to departure if, due to terrorism, natural disasters, force majeure, political instability or other external events it is not viable for us to operate the planned itinerary. If we cancel your tour, you can transfer the amounts paid to an alternative tour or receive a full refund within 14 days of cancellation - no additional compensation is payable. In circumstances where the cancellation is due to external events outside our reasonable control, we will issue refunds less any unrecoverable costs. We are not responsible for any incidental expenses that you may have incurred as a result of your booking, including but not limited to visas, vaccinations, travel insurance excess or non-refundable flights.

11. Booking amendments
If you wish to transfer from one tour to another or transfer your booking to a third party, you should notify us at least 60 days prior to the proposed departure date. A fee of $100 per person per change will apply to cover our administration costs (in addition to any charges levied by hotels, ground operators or airlines). If you notify us less than 60 days prior to the proposed departure date, the refund policy applicable to cancellations will apply. We will accept transfers to a third party only where the transferee meets all the requirements in relation to the tour.

12. Inclusions
The price of your tour includes:
• all accommodation and breakfasts as listed in the itinerary for your chosen tour - in some cases we also include selected lunches and/or dinners
• all transport listed in the itinerary for your chosen tour
• entrance fees as listed in the itinerary for your chosen tour

13. Exclusions
The price of your tour does not include:
• international or internal flights unless specified in the itinerary for your chosen tour
• airport taxes and excess baggage charges unless specified
• meals other than those specified for your chosen tour
• visa and passport fees
• travel insurance
• optional activities and all personal expenses
• tips for local staff

14. Accommodation on tour
Our standed prices are for single occupancy, however we offer discounts for couples sharing a room and also for non-photographers.

15. Non-photographers
For the avoidance of confusion we have created the following criteria for non-photographers wishing to join our tours:
• (s)he is welcome to participate in the tour with a few provisos as follows:
• (s)he is welcome to take photos with his/her phone (no SLR or tripod please)
• (s)he won't be able to participate in any workshops (ie: Lightroom sessions, etc)
• (s)he should be mindful of the photographers' space in order to position their shots
• (s)he would sit next to the photographer on the bus as and when we use one (ie: you wouldn't have that seat for your camera equipment)
• (s)he would be welcome to join in any aspect of the tour or do his/her own thing (ie: stay at the hotel or visit town on his own in those cases where the group returns to the hotel later in the day)

16. Age & health requirements
Minimum General Policy: For the majority of our tours the minimum age for children is 12. All travellers under the age of 18 must be accompanied by an adult who is responsible for the child’s day-to-day care. Please note we cannot guarantee triple or joining rooms for families.

Maximum General Policy: For the majority of our tours we have no upper age limit, though we remind you that some of our tours can be physically demanding. For all of our tours, we require all participants to submit a signed health self-assessment form. We will provide a link to this form together with our Booking Checklist at the time when we request a deposit payment.

Our trips can involve early starts, stairs, uneven ground, long walks, boats, heat, humidity and long days. You must be able to participate safely and keep pace with the group. We may, acting reasonably and proportionately, refuse participation or remove a traveller if their behaviour or condition creates a risk to themselves or others; unused services are non‑refundable where the decision is reasonable.

We can provide details on mandatory health requirements for the countries in which we run tours. However, we are not medical experts and it is your responsibility to ensure that you obtain proper and detailed medical advice at least six weeks prior to travel for the latest health requirements, recommendations for your destination and any costs. Where you do not seek advice and either are not allowed to enter any country, or suffer personal injury or death as a result, we can accept no liability to you for any cost, loss or damage which you suffer nor will we refund you the cost of any unused portion of your travel arrangements.

17. Transport & safety on tour
We use licensed local transport providers and we apply maximum driving hours and zero‑tolerance alcohol/drug policies for drivers. Seatbelts must be worn where provided. Optional activities arranged during free time are taken at your discretion, as indicated in section 25 below.

18. Minimum group size
Our tours are guaranteed to depart once they have four fully-paid participants, unless the minimum group size states otherwise. This means at times we can have small groups. If you would like to know how many people are booked on your tour please ask prior to making your booking.

19. Passports, visas & vaccinations
You must carry a valid passport and have obtained all of the appropriate visas, permits and certificates for the countries that you will visit during your tour, and your passport must be valid for six months beyond the duration of the tour. It is your responsibility to ensure that you are in possession of the correct visas, permits and certificates for your tour. We will provide general guidance but are not responsible if you are refused entry for incomplete/incorrect documents or vaccinations.

20. Flexibility
You appreciate and acknowledge that the nature of this type of travel requires considerable flexibility and you should allow for alternatives. The itinerary provided for each tour is representative of the types of activities contemplated, but it is understood that the route, schedules, itineraries, amenities and mode of transport may be subject to alteration without prior notice due to local circumstances or events.

21. Change of itinerary
While we endeavour to operate all tours as described, we reserve the right to change the tour itinerary, so please refer to our website before departure for the most recent updates, if any, to your itinerary. Before departure: if we make a major change we will inform you as soon as reasonably possible if there is time to do so before departure. The definition of a major change is deemed to be a change affecting at least one day in five of the itinerary. When a major change is made you may choose between accepting the change, obtaining a refund of money paid on the land portion of the tour only or accepting an alternative tour offered.

After departure: We reserve the right to change an itinerary after departure due to local circumstances or events outside of our control. In such emergency circumstances, we will request that you cover the additional cost of any necessary changes to the itinerary. Please note we are not responsible for any incidental expenses that may be incurred as a result of any changes such as visas, vaccinations or non-refundable flights.

Please also make sure you have access to an additional US$500, to be used when unforeseen incidents or circumstances outside our control (e.g. a natural disaster, civil unrest, strike action or a global pandemic) that may necessitate a change to our planned route.

22. Authority on tour
Our tours are generally run by Nathan as the tour leader, although we use guest photographers on some tours who act as tour leaders. The decision of the tour leader is final on all matters likely to affect the safety or well-being of any person participating in the tour. If you fail to comply with a decision made by the tour leader, or interfere with the well-being or mobility of the group, the tour leader may direct you to leave the tour immediately, with no right to a refund. We may also elect not to carry you on any future tours, even if they have been booked (although in such circumstances we would refund the cost of any such tour). You must at all times comply with the laws, customs, foreign exchange and drug regulations of all countries visited, and you also agree to travel in accordance with our responsible travel guidelines.

23. Acceptance of risk
You acknowledge that the nature of the tour is adventurous and your participation involves a degree of personal risk. You will be visiting places where the political, cultural and geographical attributes may present dangers and physical challenges greater than those present in your daily lives. We use information from government foreign departments and reports from our own contacts in assessing whether the itinerary should operate. However, it is also your own responsibility to acquaint yourself with all possible relevant travel information and the nature of your itinerary. You acknowledge that your decision to travel is made in light of consideration of this information and you accept that you are aware of the personal risks attendant upon such travel.

24. Limitation of liability
We contract with a network of companies, government agencies and individuals to assist in the running of our tours as agents for these third parties. We are not responsible for the acts and omissions of these third parties. To the fullest extent permitted by law:

• liability for any loss, death, injury or damage which you may suffer (directly or indirectly) in connection with or arising out of your participation in a tour, or any breach of the Booking Conditions, is excluded.
• you release us and our officers, employees, agents and representatives from any liability and expressly waive any claims you may have against us arising out of or in connection with your participation in a tour.
• any condition or warranty which would otherwise be implied by law into these Booking Conditions (Implied Warranty), is excluded.

To the extent an Implied Warranty cannot be excluded, our liability in respect of the Implied Warranty is limited to (in our absolute discretion): (i) the provision of a similar tour to an equivalent value; or (ii) a refund of the total amount received by us from you in connection with your booking. Any claim by you is excluded to the extent that it is for indirect or consequential loss, loss of profits or economic loss, however it arises, or for indirect, special, punitive or exemplary damages.

25. Optional activities
We contract with reputable local suppliers in the countries where we run tour. Their own terms (and applicable international conventions) may apply to the services they provide. Optional activities not included in the tour price do not form part of the tour or your contract with NHP Tours Limited and we do not own, operate, or control those services. You accept that any assistance given by your tour leader or local representative in arranging optional activities does not render us liable for them in any way. The contract for the provision of such activities will be made between you and the activity provider.

26. Claims & complaints
If you have a complaint about your tour please inform your tour leader at the time in order that they can attempt to rectify the matter. If satisfaction is not reached through these means then any further complaint should be put in writing (via email) to us within 30 days of the end of the tour with details and evidence. We aim to resolve complaints promptly and fairly and, if we cannot agree, we are open to mediation or independent arbitration by agreement.

27. Force majeure
Events beyond our reasonable control include but are not limited to: war, terrorism, civil unrest, epidemic/pandemic, natural disaster, industrial dispute, significant weather events, and related governmental actions. See your rights at section 10 above.

28. Data protection
We process personal data as a Data Controller under IoM Applied GDPR/UK GDPR where applicable. See our Privacy Policy for details of what we collect, why, and your rights. Any personal information that we collect about you may be used for any purpose associated with the operation of a tour or to send you marketing material in relation to our events and special offers. The information may be disclosed to our agents, service providers or other suppliers to enable us to operate the tour.

29. Behaviour & code of conduct
Please respect local cultures and our hosts, as abuse, harassment, or dangerous behaviour isn’t tolerated. We may end your participation on reasonable, proportionate grounds if your conduct causes or is likely to cause distress, danger, or serious annoyance; in such cases no refunds are due and you are responsible for your own onward travel/accommodation costs.

30. Late payments & non-payment
If balances are not received by the due date, we may cancel your booking and retain cancellation charges as per section 9 above. We reserve the right to charge reasonable admin costs and any bank/FX charges arising from late or incorrect payments.

31. Variations & transfer of rights
These Conditions apply to the extent permitted by law and cannot be varied unless agreed by us in writing. You may not assign your rights except as set out in section 11 above (name/booking transfers).

32. Severability
In the event that any term or condition contained in these Booking Conditions is unenforceable or void by operation of law or as being against public policy or for any other reason, then such term or condition shall be deemed to be severed from this contract or amended accordingly only to such extent necessary to allow all remaining terms and conditions to survive and continue as binding.

33. Applicable law & jurisdiction
These Conditions and any dispute or claim (including non‑contractual) shall be governed by the laws of England & Wales. The courts of England & Wales shall have exclusive jurisdiction, provided that mandatory consumer protections in your country of residence may also apply where required by law.
